1. TERMS
By accessing this website, you are agreeing to be bound by Get It Washed’s Terms and Conditions of Service, all applicable laws and regulations. If you do not agree with any of these terms and conditions of service, you are prohibited from using or accessing this site. Applicable copyright and trademark laws protect the materials contained in this website.
Get It Washed is not responsible for any items left inside of the laundry (pockets, socks, etc.). Get It Washed is not responsible for the damaged clothing caused by items left in the customers’ laundry. Customer will assume all liability for damaged clothing.
2. USER LICENSE
Permission is granted to temporarily download one copy of the materials (information or software) on Get It Washed’s web site for personal, non-commercial transitory viewing only.
This is the grant of a license, not a transfer of title, and under this license, you may not:
1.modify or copy the materials;
2.use the materials for any commercial purpose or for any public display (commercial or non-commercial);
3.attempt to decompile or reverse engineer any software contained on Get It Washed’s website;
4.remove any copyright or other proprietary notations from the materials; or
5.transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and Get It Washed can terminate the license at any time. Upon terminating your viewing of these materials or upon the termination of this license, users must destroy any downloaded materials in their possession whether in electronic or printed format.
3. DISCLAIMER
The materials on Get It Washed’s website are provided “as is”. Get It Washed makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Get It Washed does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Get It Washed website or otherwise relating to such materials or on any sites linked to the Get It Washed website.
4. LIMITATIONS
Get It Washed or its suppliers shall not be liable for any damages (including, without limitation, damages for loss of property, data or profit, or due to business interruption) arising out of the use of the Get It Washed website. Some limitations may not apply to you because some jurisdictions do not allow limitations on implied warranties, limitations of liability for consequential or incidental damages.
Get It Washed recognizes that the recovery of lost or stolen property must be given to any customer. In the event items are not recoverable, Get It Washed agrees to replace or give market value for missing, lost, stolen or unrecoverable items. Get It Washed agrees to replace any lost, stolen, or unrecoverable item(s) at an equal market value, not exceeding $500.00.
5. REVISIONS AND ERRATA
The information appearing on Get It Washed website could include technical, typographical, or photographic errors. Get It Washed does not warrant that any of the information and/or materials on its website are accurate, complete, or current. Get It Washed may make changes to the materials contained on its website at any time without notice. Get It Washed does not make any commitment to update the information listed on its website.
6. SUBSCRIPTION BILLING AND CANCELLATION
6.1 Access to Subscription and Parameters of Use.
To access Get It Washed subscription, discounted pricing, subscription services, you must provide one or more payment methods. Subscriptions are Weekly or Bi-Weekly (twice per month) and discounted based on the number of pick-ups and bag size. All subscription discounts are given from the non-subscription pricing. To obtain and be eligible for subscription pricing, the customer must have: (1) a credit card or bank account on file and/or attached to their Get It Washed and Square account; (2) have auto-debit or auto-draft set up. Customers are held to bag limitations of twenty-five (25) pounds per Standard Bag and forty-five (45) pounds per Luxe Bag. Bags exceeding these maximum weights will result in an additional $1.99 per pound in “overage” cost. Mini bags excluded and have been eliminated as part of services offered by Get It Washed, LLC. Customers may continue to use them only to separate the laundry. However, if the subscription bag is over limit and a mini is used in addition, all contents and laundry over the limit are subject to a charge of $1.99 per pound. Get It Washed reserves the rights to enforce these limitations at any time.
6.2 Payment Methods.
Payment methods are to be automatically debited on the 1st day of each month. Users authorize Get It Washed to charge any payment method associated to the users’ account. In the event that the primary payment method is declined or no longer available to Get It Washed for payment of the users’ subscription fee, the users remain responsible for any uncollected totals. If a payment fails due to expiration of the associated credit card, insufficient funds, or otherwise, Get It Washed will suspend your access to the services until we have successfully charged a valid payment method.
6.3 Subscriber Unsuccessful Payment.
If funds are not collected within the first five (5) days of the month or before the next service, whichever comes first, no services will be provided until the account is paid in full. If the account is not paid in full by the 6th day or before the day of service, whichever comes first, the customer will lose the Subscription Discount. The customer may sign up for subscription services for the following week at a prorated amount, not to exceed 4 weeks. Users are responsible for all fees, such as foreign transaction fees or other fees, relating to the processing of your payment method. Check with your payment method service provider for details. Get It Washed is not liable for any such fees or fines.
6.4 Billing Period.
Get It Washed will pull all appropriate funds, based on the chosen subscription plan, on the First day of each month. The subscription plans are based on two or four pick-ups (including subsequent delivery) per month. If an additional pick up (or a 5th pick up) is allotted for a particular month the customer may opt not to have the items picked up or the customer can choose to have them picked up at a discounted cost from the original Standard (non-subscription) rate. Get It Washed reserves the right to update or change the amount of all discounts at any time without notice or give the additional service pick-up free of charge.
6.5 Updating your Payment Methods.
You can update your payment methods by contacting Get It Washed via email or phone. You may also update your payment methods using information provided by the payment service providers (Square, Inc.). Following any update, you authorize Get It Washed to continue to charge the applicable payment method(s).
6.6 Cancellation.
You must cancel your Get It Washed subscription at least 1 month (28 days) prior to the date funds are to be auto-debited. You will not have access to services past the time paid in full, but may continue to have access to the Get It Washed and its services through the end of your billing period. To cancel, email us at info@getitwashed.com. Please include your name and address to ensure cancellation. If you cancel, your subscription will continue until the end of the month and the billing period paid in full.
6.7 Changes to the Price and Subscription Plans.
We reserve the right to change our subscription plans or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes or changes to your subscription plan will take effect following notice to you. If the customer fails to notify Get It Washed of a scheduling change, needed twenty-four (24) hours prior to a scheduled pick up, then Get It washed will charge a $10.00 convenience fee for a blank trip. Biohazard fees are assessed when there is, but not limited to, potential danger to the Laundry Expert or damage to the Laundry Expert’s properties. Danger to the expert is any type of communicable disease, virus, or bacteria which may inhabit clothing and thus contaminating the bag and/or air in which the Laundry Expert is exposed. (E.g. Covid-19 on clothing due to an infected customer). Biohazard fees may also incur if the clothing is damaging to the Laundry Expert’s property including, but not limited to, house, car, washer, and dryer. Such items nay be diapers, pull ups, sharp objects left in pockets or placed in the bag, lighters, weapons of any sort, etc. If such items are found Get It Washed will return them as best as possible. If damage is incurred there may be a Biohazard fee assessed. Customer may reschedule or cancel services without penalty to avoid infecting and spreading the condition. Get It Washed reserves the right to cancel, reschedule, or charge a BioHazard fee of no more than $100.00 to the customer for any situation that may adversely effect the Laundry Expert or leave them exposed; general rates are as follows: Standard $50-$75 and Luxe $75-$100.
6.8 No Refunds.
Payments are nonrefundable. There are no refunds or credits for partially used periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at Get It Washed’s sole and absolute discretion. The granting of credits in one instance does not entitle users to credits in the future under any circumstance.
7. PAYMENT
7.1 Use of the Site.
Use of this Site is free of charge. Get It Washed reserves the right to introduce a fee for the use of these services. If Get It Washed decides to introduce such a fee, Get It Washed will inform you accordingly and allow you to either continue or terminate the services.
7.2 Services.
Get It Washed charges for the services that you request. Services may include dry cleaning, laundered shirts, wash & fold, or other related services ("Cleaning"). You agree that you will pay for all cleaning services purchased through Get It Washed. You agree that Get It Washed may charge (including any taxes, late fees, or additional fees as applicable) the credit card associated with your Get It Washed account for all cleaning services that you purchase from Get It Washed. You are responsible for the timely payment of all fees and for keeping your credit card information up-to-date. All payment made are non-refundable.
If payment is not received within seven (7) days after delivery of your items, a fee of $1.00 per day will be added to the total of your order until the bill is paid.
7.3 Payment Processing.
Get It Washed may use a third-party payment processor (the "Payment Processor") to link your credit card account to the Services. The processing of payments or credits, as applicable, in connection with your use of the Services will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to these terms. Get It Washed is not responsible for any errors by the Payment Processor.
7.4 Due Date.
Payment is due before the service is rendered. In the event that you are not at home, you authorize Get It Washed to charge your card or the total amount due, if payment has not been made already.
7.5 Money Back Guarantee.
Get It Washed will return any monies acquired, either in full or partially, for cleaning that is not satisfactory to Get It Washed standards. Get It Washed reserves its rights to review and make a determination regarding all customer complaints, issues, or concerns.
Users may pursue any other remedies available to them after Get It Washed has made a determination.
8. LINKS
Get It Washed is not responsible for the contents of any linked websites. The inclusion of any linked websites does not imply endorsement by Get It Washed. The use of any linked websites is at the user’s own risk.
9. SITE TERMS OF USE MODIFICATIONS
Get It Washed may revise these terms of use for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
10. MEDIATION.
If a dispute arises between or among the Parties, and it is not resolved prior to or after recording, the Parties shall first proceed in good faith to submit the matter to mediation. Costs related to mediation shall be mutually shared between or among the Parties. Unless otherwise agreed in mediation, the Parties retain their rights to proceed to arbitration or litigation.
11. GOVERNING LAW
The laws of the State of Louisiana without regard to its Conflict of Law provisions shall govern any claim relating to Get It Washed’s website.
